I agreed to rent an apartment in GA from a little old lady. She sent me with her son to sign a lease. During a period of at least 3 hours, he made several statements that made me feel uncomfortable living so close to him, especially being a single female. I called the next morning and told her I would not be taking the apartment. He took me to court to charge me for cancelling the lease (he does not own the apartment, she does). What are my rights? Had he not made these horrifying statements, I would have been living there! Am I responsible for the money HE is trying to obtain from me?

First off he cannot take you to court unless he is the owner or part owner of the property, or unless he has LEGAL power of attorney over her affairs..otherwise she has to sue you...

So find out where you city keeps its records dept, and get a copy of the title or deed to the property and if his name is not listed then tell the judge only the owner can sue and he is not the owner.

Also write down the things he said and a choice four letter word or two would not hurt.

Check GA law about who can take you to court. He may be the legitimate agent of the mother.

As for his statements, remember the First Amendment of the Constitution. You generally cannot escape from an obligation because of something that someone said to you that made you feel uncomfortable.

Why does it take 3 hours to sign a lease?
