I was involuntarily terminated on 9/12/07. The company's contribution to my 401-K was around $12,000, with a policy of 100% vesting after 3 years employment. I was terminated 2 weeks shy of 2 years.

The company's contribution was pulled from my 401-K account. However there are currently negotiations under way about my separation between my lawyer & the company. One of the items we put on the table is the company reinstating & 100% vesting the $$$ they contributed up to my separation date.

Is this at all possible for a company to do? If the company says, "We can't do that." are they really saying, "We can, but we don't want to do that." What are the hurdles a company would have in doing this?
