terminated while on WC

Was on the job almost 33 yrs. Hurt my back at work in Oct. 07, it took WC 2 1/2 months to approve surgery. Rehurniated disc in PT work harding. Dr. had another MRI, Mylogram and then a Dicagram done on me. It showed I had 3 bad disc and needed a fusion. This was Sept 08. It took WC 6 weeks to set me up with an IME. This guy gave me a 5 min exam and said there is nothing wrong with me but I can't do the same job I've been doing? So then I was going to have surgey done on reg work Ins. but my Dr needed a denial letter from WC first. Case nurse tried to get letter from the adjuster for several weeks. Next thing you know I received a letter from the nurse saying she has been terminated. On Jan28,09 I was terminated and 3 days later I received a denial letter.
My union contract states if i'm off work for 1 year due to illness or accident i'll be terminated.
Can the IC delay 6 months of decision making ?
Or is the ER telling the IC what to do?
Just wondering if someone had some advice?
Have I got a wongful termination suit?
I'm also going to court next week to force WC to give the surgery..
