I have a situation that I can not find any help with concerning the termination of child support. My daughter is going to finish her last semester of high school by going to college (next year). The only class she would lack to complete her high school credits at mid-term, is a half credit of English, which she may take at a credited college for high school credit as well as college credit. She will turn 18 between the semesters, right before the college semester starts (Jan). My decree states I must pay child support until the child is 18, or completes high school, which ever comes last. Here is the exact wording from the decree:

"child support is continuing until said child attains the age of 18 years, unless the child reaches the age of 18 before completing her high school education, in which event, the support shall not terminate, unless otherwise ordered by the Court, until June 30 of the school year during which the child becomes 18, if the child is still attending high school."

Technically, she wont have her high school degree in hand, until May, but on the other hand, she will not be attending high school after turning 18. My question is, do I have a shot at terminating the support at age 18 (Jan), or will I have to wait until she officially has the high school diploma in hand (June)? I'm probably going to be consulting a lawyer down the road for this anyway, but I would like to hear about any similar cases if anyone knows of any. Thanks. What is the name of your state?

Just curious, but who will be supporting her after she turns 18? Will she be leaving for college in January? Or will she live with your ex while attending college classes?

You have a child that is so bright that she is being admitted into college early, and your primary focus is to stop supporting her?

I don't know if anyone else here will give you advice on how to accomplish that, but I certainly won't. Go pay an attorney for advice.

Actually the answer is he has to support her until May when she graduates from high school. Because she will not have the English credit needed to graduate until then. But I agree with Ld and Fair.

I guess I was a little mis-understood. I plan to support her 100%,
while in college. I will be paying for her college, and she probably
will be living with me during college. She currently lives with me
50% of the time, and I still pay child support, alimony, ex's mortgage,
and all medical for the child.

And you got your answer. You owe child support until MAY.
