What is the name of your state (only U.S. law)? LA

Dad wants to terminate parental rights. What does this mean as far as child support and communication with other members of his family?

Any words of wisdom? I don't want to confuse my girl, but I think she will be happy in the long run. He just is not in her life, and chooses drugs over her.

Is there a step father there to adopt her? Otherwise, the state may not allow a TPR - who would support the child if you were unable?

If a TPR occurs, dad pays no more support. He gives up all rights to visitation.

Does dad';s family have a relationship with the child?

Why do you have to terminate rights? Is dad trying to exercise his vistation?
 
Dad is about to go to prison for major drug bust. Dad never drug screened and was arrested last week. I have noone to adopt my girl, and am very close to dad's mother and niece, and other extended members of his family. Dad was taking me to court for 50/50 for control only. He was throwing it in my face of how I was going to lose all of that time with my angel, and telling me I had to get a life since she would not be there. He only did it to torment me.

So, when Dad ends up in prison, you file for a modification of his visitation based on that. I doubt very seriously any judge is going to let you TPR, but you should be able to modify visitations/custody status (ie; joint legal to sole legal).

Then your reasoning is just spite.

That's not a legal reason to remove her father permanently from her life.

I don't want to explain to my daughter that her father is a piece of crap who was willing to walk out of her life because he preferred drugs and money over his girl. He does not want to pay child support, and we have another court date coming up at the end of the week, that he will be found in contempt for. He has not taken his court ordered drug screens, and was just arrested for drugs last week. I'm pretty confident that the judge will not like that. I am against terminating his rights, and was merely asking because I am close to his family, and I do use his child support for my daughter's Catholic School Education. That is all......

You do realize that once he goes to prison you are not going to be getting any child support? He will accrue arrearages but you won't be receiving anything.

If you are close with members of his family, you could continue to be close to them even if a TPR happened. That's between you and them. However he cannot terminate his parental rights in this instance.

Wait and see what happens with dad's criminal case before you decide what to tell your daughter.

Hun, Sole Custody does not mean that you will get to do everything on your terms. Trust me on that one. As far as major decisions go (education, medical, religious) sole legal custody grants that. All sole physical custody grants you is the right to have the child live with you (and you can make those decisions [where and how]) within the confines of the court order or state statutes.

As far as why she can't see Daddy? That depends on the age of Daughter.
