Hi all,

We have a subscription for business use. We do not want to renew it anymore (it is over $30K/year).
We sent them a letter 2 months prior to the renewal date. They say we should have sent the letter 90 days prior to the renewal.
I checked the policy, yes in their policy, they say it is automatically renewed unless a request letter is sent 90 days before.
My question is if we have any legal right not to pay any fee, or should we just accept what they offer us. Probably they will ask us to pay 1/3 or half of the subsc. fee.

Thanks.

"Legal right"?

No.

You are in breach of contract. You can be sued for the entire year.

That's up to you and between you and the provider.

For the time being, however, I suggest you consider withholding payment until you work something out and get a written settlement agreement.

As long as you have your money and they don't, you have a bit of leverage.

Again, that's a choice you have to make.

Might be wise to have the contract reviewed by an attorney before you do anything.

If the policy says you must cancel 90 days in advance of the renewal date, you need to inform the subscription service you will not renew 90 days in advance of the renewal date - so, no, you do not have a "legal right" to breach the terms of your agreement.
