i live in Tujunga,California was given a termination of tenancy was told the landlord wants to refurnish the house because houses are getting 50% more rent in area.I am not behind on rent.When we moved in 3 yrs ago was told that a gate would be installed in place of ball of wires.also that back room would be repaired.neither was done so i installed 300.00 fence and drywalled and replaced floor in back room bacause it caved in.also was left with 5 ft hole you could drive a car into in my front yard for 5 weeks which the city tried to condemn the house because of open sewer.i ask the management company for reimbusement for repair they refused because i made the deal with prior company.now have given me a unlawful detainer w/ 5 days to respond.what should i do?i need help by monday please help family with three small kids.

Do I understand that you were notified that your tenancy was being terminated, but you stayed in the property anyway, and now you have been sued for unlawful detainer?

Landlord has that right, you know.

You need to respond in 5 days, but what can you respond? That you left as required after being notified of termination of tenancy? Anything else would be phony.

How long did you have to find a new place to live after being notified that your tenancy was being terminated? 30 days? You should have used that to your advantage to find a new place to live.

So many people try to play the child sympathy card, thinking that because they have children that they are exempt from the law. They don't succeed. I have children, too, but I obey the law. The responsibility for caring for the children is YOUR responsibility, not the landlord's or the court's, and it includes the responsibility for providing housing for them.

All of the other items that you mentioned are irrelevant and have nothing to do with the basic cause of action here, namely that your tenancy was legally terminated, you were given notice to leave and you didn't, thereby committing unlawful detainer. Is that what happened?

Use this weekend to find another house, pay the landlord anything that you might owe him, and get on with your life.
