I was hired as a temporary employee in New Mexico, working 20-30 hours per week through a temp service. This was my first and only assignment through this service. As time progressed, my hours increased to 40 hours per week. The company was unable to hire me due to policy, however after one year I was working full-time and had received regular raises. When I gave my termination notice due to my husband being transferred, the company asked me if I would be interested in telecommuting and continuing employment. I agreed and rented a home large enough in Texas to accomodate a home office at approx $150/mo extra. I purchased office furniture and used my own computer equipment. I furnished cable internet access, and the additional utilities associated with running the office from my home. Also, at my expense, I traveled back to New Mexico once a month to do filing. I also traveled at company expense to conduct training classes. During my employment I developed an extensive Access Database, many training aides, and designed and posted a large website for my department. Most of this work was done on my own time, hoping eventually to obtain permanent employment. Recently, my supervisor was put on suspension and when he was allowed to return to his job, I was told part of his reinstatement included relocating my job back to New Mexico, as the remote situation was not working. I was never informed that my job performance was less than satisfactory, in fact, have several emails praising my work. I was never informed that the remote situation was not working, nor was I given the opportunity to correct any deficiencies. I was basically fired and told I had 2 weeks to transfer the files and office back to New Mexico. To further complicate things, during the last month, the temporary agency changed my timecard without my knowledge and has refused to pay me for the time owed.
I was termed temporary purely for the convenience of not adding head count and having to provide benefits. For all practical purposes I was a full-time, permanent employee. There was/is nothing temporary about the job assignment. I have copies of emails supporting my position. Currently, they are trying to create and open a job locally for me in a different department. I'm not sure I'm interested in the job, and there have been several snags and quite possibly could be another month before the job is available. Do I have anything at all here? Thanks for any advice!
