What is the name of your state? Georgia

I recently purchased a home here in GA, and on Sept 13 a Termite Inspection was done on my home by a Local Mom & Pop Company. This inspection showed "No Termite Damage" and "No Current Termite Activity". On that same day, the home was treated for Termites. I closed on my house on Sept 22nd, and on Oct the 24, I discovered Active Termites in my Garage. Upon this discovery, I called in Terminix for a Full Inspection of my home and Garage. Within 5 minutes, Active Termites were discovered throughout the home, and 57 areas within the homes construction had massive damage from Ternites.

I currently have the Termnite Inspection used at Closing that shows "No Active Termites" and "No Termite Damage Present" against the Terminix report that shows "Active Termites" and "Severe Termite Damage Old and New".

What should I do and do I have any recourse? If so, where do I start?

**A: simple, you have the home treated.

Yes, you have recourse.
Do you have a copy of the 'mom and pop' exterminator bond and license information?? If so, file a claim with their bonding company.

The GA agency responsible for pest control is at: http://www.georgia.gov/00/article/0,2086,5426814_39039081_38230764,00.html

Contact the 'mom and pop' company in WRITING (certified RRR), include a COPY of the Terminix statement. Ask them for a response to it and for a copy of their bond/license information if you don't already have it.

In the meantime.. you might talk with a local attorney who can review all of your facts... and take appropriate local action.

Just have the home treated? Well, did that already at my expense of $1200.00. What about the existing damage that the original Termite Company did not disclose? Aren't THEY liable for not disclosing the damage? Had I known of the extent of the damage ( that is supposed to be disclosed ) I would not have purchased the house, or at least, I would have insisted the price be lowered or the seller reapir the damages.

Seems as though the termite company has covered for the seller as he is a contractor and this termite company handles all the homes he builds, remodles and selles.

Someone should be liable for the "OBVIOUSE" damage that was not reported shouldn't they?

Am I able to file a claim with the Pest Control Companies Bond Directly? Would they not just laugh and thow it in the trash as I have no intimidation?

If I do such, should I supply the information and report I received from the current pest control company that I am using which shows the present and existing damage?

Does anyone have any idea on what field of an Attorney I should contact regarding this?
Yep. Any decent licensed attorney in your state should be able to handle this one. If you really want a specialist, you might consider one with a 'Real Estate' practice.
