Terrorist Threat leads to arrest of son,who is diagnosed high functioning autistic/PD

My son was looking at the internet at a site for guns in his special ed class,the teacher asked him if she should be afraid,not
why are you on this site,it was for a topic
"right to bear arms as he was in the process of mainstreaming.Other students overheard and
gossiped.Later a student overheard a comment
in response to an incident involving the use
of a calculater by my son on a math test about a girl that reported him he said to
another student when asked what are you going
to do about the girl that told on you he replied jokingly "what do you want me to do,
shoot her"this was a response,but there are
many questions here.He is very intelligent and the teacher created hysteria and the paradox exists on the issue of the teacher
reporting him on the gunsite which was for a
topic on persuasive essays by the same school
the teacher gave this report to the police.I have two copies,the students and the teachers
the one which he was going to use(right to
bear arms)before it was chosen by another student and the teachers after the incident.
He was charged with a terrorist threat,but I
feel that he missed any education on such matters because he was in special ed for so
many years,also I have to this day not seen a police report.There are more facts.

Have you consulted with a criminal defense attorney? An attorney would be able to gather evidence thru a process called discovery and would be able to get his hands on the police report to find out what witnesses may say in court. Your son's autism will be relevant to his defense as well. In light of the fact that the assignment was on the topic of bearing arms, the paper may not be that significant a piece of evidence against your son. Unfortunately, teachers need to be more paranoid in light of all the recent events in our country's schools. I strongly recommend you consult with an attorney. There are referrals onthis website.
