My son and I have been subpoenad to give depositions in a criminal case against his father, here in Indiana. Does my 17 year -old son have to testify against his father? Do I have the right to stay with him as he makes his depostion? What changes when he turns eightenn, if anything? Thanks!

You should post this in the criminal section but I might be able to help a bit... however i could be wrong. I'm in a similar situation nowand I'm also in Indiana. My brother-in-law is in jail and the best witnesses the prosecution has is his parents and his brothers. The story I've gotten is the only person allowed to get out of testifing is a spouse. Even his parents are not immune to this if they are chosen to testify. Is the father still in jail? How does the son feel about his father. You may be able to stop visitation if the crime is of significate manner to a, protect your son and to b, prevent the father from playing mind games on him. As far as you being in there during the deposition I doubt you can but I may be wrong.
