What is the name of your state (only U.S. law)? Ohio

My wife and I have been fighting for a year or so and I think she is having an affair. There are plenty of things that have led me to believe this, but the only little evidence I do have are their text messages. If I go through with this can I have the text messages mulled to see what they say? If so how do I do it?

What are you hoping to gain by this? If you are so miserable in your relationship, just end it.

End the relationship? Nah. It is so much more fun to spend time, energy and passion trying to dig up and document as much dirt as possible than it is to simply end the relationship with no fuss and muss!! Then you have all this great stuff to gossip about and it "proves" who the good guy was, establishes a "victim" and proves to everyone that it was appropriate to end the relationship. Sheesh!!

Waddya expect? Someone to try and work on a relationship?!! Go to counseling? None of that is fun - that is work!

Adultery isn't against the law and so few courts actually care as to whom is schtupping whom that it means NOTHING.

So, divorce her or don't.

Rather than going through her texts... why not just ASK her if she wants a divorce?

Technically, the courts CAN consider adultery in OH in setting spousal support and even property division. OG will know if they actually DO consider adultery, but it's at least theoretically possible (in that the law states that the judge can consider anything he considers relevant).

However, even if the judge WILL consider it, it's probably wasted energy. It's not likely to change things much and will likely convert a divorce that might be uncontested into a nasty, expensive, contested divorce.

To go through someone's texts is dicey even if it establishes an affair. Especially if the cell phone account is not in his name.

Not only dicey, but likely illegal if the phone doesn't belong to you. Even if a hard copy of damaging text messages were obtained, it would likely not be admissible in divorce court.

Trust is a gift. If you don't trust your spouse, confront and take action- one way or the other.
