What is the name of your state? New York

Situation: Dental "consultant" (her/she) refers patients to dentists and collects commissions. People on my Internet forum are critical of her advise. She wants criticism removed and is threatening defamation suit.

I Believe: 47 U.S.C. §§ 230 protects me from losing suit, BUT—I wonder... How much it will cost to win the right of free speech for my faithful forum members?

Question: She's in California. I'm in New York. Forum Terms of Service say litigation must be by arbitration in New York. So...

(1) If a suit is filed, do I have to travel to California?
(2) Could the case really occur in New York?
(3) What other expenses could incur during this process?

If she files there and it survives a venue challenge, yes.

Could the case really occur in New York?
The case could occur in Timbuktu if the court agrees it has jurisdiction.

What other expenses could incur during this process?
Phone calls? $10.00
New suit for court? $50.00 (at Goodwill)
Embarrassment for asking stupid question on this forum?? Priceless.
