Hello..I am in Texas.My wife and I have been seperated for 4 years after she left me and took our son.I have been in the house since then..my ? is this: I do not want to sell the house and she refuses to let me buy her out. Can she be forced by the courts to sell her portion of the house?I have paid all home owners ins.and taxes since she left.Both of our names are on the mortgage loan.

My response:

Yes. You must sue her for "Partition" - - that is, think of Partition as dividing up a pie, and giving her a slice. Then, the rest of the pie is yours.
