THe KID is 18...MOM wants Support.

My Husband was awarded custody of his son 6 years ago. The kid turned 18 in January. During the summer while he was visiting his mom, the Son decided to stay with her rather than return back home with his father.

During the 6 years the son was living with us, his Mother did not pay one dime of support, nor did we ask for it because she has no income or money. however now that he has choosen to live with her against my husbands wishes, his mom has filed for child support.

We live in MT. My husband works a seasonal part time job so that we can be sure one of us is home with our kids when needed. I work full time and provide the major income for the family. 2 questions. 1) What is the likely hood of the courts granting her support? 2) If granted, will they take my income into consideration?

We don't have the money to hire an attorney so I am hoping someone here will provide us with some useful information.

Was custody changed legally? If not don't pay her a dime. If it was... let her take him to court for support. Is the child in school? I'm sure he could fight it if he isn't and if he is it probably won't be for long. If she gets off her butt soon enough to get to court I'm sure he could handle it in court without a lawyer and should stipulate when it ends. He can't go back and get support for the six years the child lived with him though.
