Massachusetts private resident sold a motorcyle to a private party. He explained to the buyer that the motorcyle had been in an accident and that the motorcycle had a Salvage Title. The buyer purchased the motorcycle and was able to get an inspection sticker on the motorcyle.A short time later the buyer discovered the front forks(tree)of the motorcycle to be bent. The buyer is now threating to sue my friend in small claims court to either repair or get his money returned to him. He says he can achieve this under the Ma.Lemon Law. Is this true? My friend,the seller, was not aware of the extent of the accident the motorcycle had been in under which it was salvaged. The salvage title is approved by the state. Who is resposible for the repair the seller or the buyer?

My response:

The buyer can sue you in Small Claims Court. The problem is, he won't win. The Lemon laws in the 50 States concern new vehicles and problems with the vehicle manufacturer. There are no warranties of merchantability or fitness for a particular purpose laws covering the buyer.

The buyer bought a private party used motorcycle and should have had the bike inspected by a mechanic prior to purchase.

He bought a bike, plain and simple. Caveat Emptor.

Dear I am always liable,

Thanks for your reply! It meant a great deal to us as my friend was just getting ready to pay for a repair to this motorcycle because he was afraid this kid was going to take him to court and perhaps win more than it would cost my friend to simply pay for this repair.
I tryed to tell my friend this kid could never win as the kid new exactly what he was buying when he bought it and the kid accepted any other faults with the bike as his own problem when he made the purchase. I know my friend will now believe what I am trying to tell him. Thanks Again for your help.
