What is the name of your state? Missouri

MY question is I was caught shoplifting by mall police finding
torn off price tags. this was my first offense and during that
time the mall police conducted a illegal search and told me i
have no rights. is that true? what are my rights as a minor?
can i do anything about the illegal search they conducted?
they told me i could not only no loger enter their store until
i am 18 but i cant go on their mall property including all the
other malls in the city that are not their property, is that
true can i not go on their entire mall property or anyother
mall propertys. I was fined $250 and was paid, does that
make any difference whether i can go there or not?

If they told you to stay off of their property then stay off their property. If they do not own the 'other' mall (which I would highly suspect they do since most management companys own several) then you are free to steal from that mall only.

Ok where in the missouri state law or in the us constitution
does it say when you are not arrested that you do not have
any rights? and i am asking about my rights because i have a
right to know! and no i am not going to any malls,and i have
learned my lesson from my stupidity from what i have done
and never am i going to do it again.

Of course you have rights. WHEN arrested by a police officer.

When you are detained by private individuals you have ONLY the rights they want to give you. Including keeping your ass off their property.

So, what are you going to do now? File a multi-million dollar lawsuit and lose or grow the hell up.

**A: what grade are you in anyway? You have very poor spelling and grammar. Concentrate on your education rather than trying to stay on a flimsy soap box. And no, you have no rights to know here. If you feel you need to know something, ask your parents.

How about you answer my question, Where in the United
States Constitution or the Missouri State law does it say
that I don't have any rights when I am not arrested? :confused:

Why was it an "illegal search"? Because you said it was? They had you in custody and they searched you ... and found the stolen property. It sounds like they had good cause for the search.

Plus, they are not the government so they do not have to extend you any "rights". If they detained you without cause or used force to hold you, you can TRY to sue or criminally charge them for false imprisonment or battery ... but I can guarantee THAT won't happen as their intent was not to hold you against their will or beat you up for jollies.

You can get an attorney and sue them. But, as others have said, that won't happen.

I doubt that they have control over all the other malls. But they can certainly prevent you from going on the property of any mall owned by the company that owns the mall where you were caught. And, there might be an agreement among the malls that anyone caught stealing at one can be told not to go to any of the others as well. That would be easy - especially if they all have the same security company.

You were not "fined" - you received a civil assessment. This helps compensate them for the time and effort they went through to deal with you. Paying it just means that they got compensated. It also means that you are getting out of this without a criminal record. Consider yourself lucky that they did not call the police.
