They moved out, but stuff is still there!

Rental Property in San Jacinto, Ca

I rented to a single mother starting in Oct 07. At the beginning of this month, (on Jan 10th of this year to be exact,) she calls me up and tells me she can no longer stay there because the house is haunted. (She has claims the doors were opening and closing on their own and her daughter saw a monster and three girls in her room that told her she should cut her hair.) Anyway, she claims she is no longer staying at the property. She also feels that since she is no longer staying there she should not have to pay rent. So for the month of Jan she didn't pay rent. But the kicker is, she still has all of her things at the property. She hasn't moved out. I have sent a 3day notice to pay or quit to the home, but I'm not sure that she has been back to receive it. (But I did send a copy certified mail, and one through the regular mail.)

I know she has a relative staying in the same city very close but I do not know where, and that is where she has been staying. She won't return my phone calls or voice or text messages, and home phone is disconnected. If I don't hear anything back from her by Monday 21 Jan, I will send out the Lease Termination Notice, but then what? If I can never get in touch with her, how do I evict her? If I cannot find her can I still server her an UD? It's like she is just using my place as storage.

I've asked the neighbors to keep an eye out for me to see if she surfaces, and they both say she hasn't been seen for at least a week.

By the way, I lived in the house for 3 yrs prior to her and did see one poltergeist or have anything odd happen. Neighbor has been there for 41yrs since before the house was built and she says no one has ever died there.

Please help..

sounds like she is off her meds... Even though she left the home her stuff is still there. You will most likely need to follow through with the eviction process which should be started immediately. (I am assumming she did not pay you Jan rent which means its futher enough into the month as to have started.)

Find out what the laws are in your state about abandoned property and how much notice you have to give her before you can throw everything they own in the city dump.

You obviously need a landlord/tenant attorney. Please.. oh PLEASE do not attempt to do this on your own.

No need to send the lease termination. If she doesn't pay at the end of the 3 day notice, you need to have someone file a UD for you (because you don't sound like you know what you are doing). Make sure it's done the right way the first time. The attorney will also be able to tell you what to do with the property.
