ok, long story
My mom lived in this apartment for about a year and the lease is just month to month. she decided that she wanted a bigger place so she decided to move. at the time a couple of family friends needed a place to stay so my mom talked to the landlord and she said it was ok. my mom told her that if there were any problems to contact her asap. btw the landlord never required the friends names to be on the lease. abouth 8 months ago they got behind on the rent, my mom was contacted by the landlord and it was resolved quickly. the friends swore to never be late again so my mom let them stay. yesterday my mom got a call from one of the supposed family friends saying that most of her stuff that was left in the apartment was set out for trash and her extra vehicle that was parked there was gone. he then goes on about how they had gotten behind on the rent a they were delivered a summons for her and thought they could take care of it without her knowing. they went to court for my mom with out her even knowing about it and pissed the judge off so he gave them a 10 day eviction notice. they still thought they could fix it so they still didnt tell my mom about it. the landlord never called her either. anyways 10 days later they went to return home and were locked out. then they called my mom. my mom called the landlord and she said to my mom that anything left at the house was no longer hers. and she had said that she hired guys to go in there and told them to clean it out and they could keep anything they wanted. they even took her car and stripped it. she found it parked in front of one of they guys' house that was cleaning out the apartment. the landlord told her she was SOL, even though the vehicle was parked on public property(public street) and was legal(tags and insurance). anyways, my questions are:
can someone go to court and answer to the charges against someone else if they are not even mentioned on the summons?...(my mom's wages are going to be garnished for this too)
and
can they keep her car if it is parked on public property?
sorry so long, just wanted to get my point across. and yes i know my mom was being stupid for allowing these a-holes to live in this apartment.
