What is the name of your state? vt..so I called the administrator for the OCS. They called the office I complained about in not letting me see my file. They set an appt. for me to go to the office, then I had to sit with the OCS attorney who had my file, and who also told me that she is the one going after me for the arrearages in court, even though there are mistakes by the hundreds of what I owe. She claims that was 7 years ago and the errors even if there I should of appealed then, before the new order stuck. I didnt even see these errors until yesterday. And I am baffled how this meeting of wanting to see my file turned into a battle of this is what you owe. Plus here I am answering questions to the person who is taking me to court to begin with. hmmmmmmm
Do you have an attorney? You really need one if you want to have any chance at all of fixing OCS's screw ups. Even then, it's going to be very difficult to get a Judge to care about the truth, and be prepared to have to pay all arrears, even the overcharges due to OCS's mistakes. My husband fought for over 5 yrs in Fl against FL and GA's CSE screw ups. Like you, he didn't find out about the problem for a few years, like you he was told "you should have appealed it when it happened". For some crazy reason no one, not the CSE agencies nor the Judges want to look at the reality that if a person doesn't know a problem exists, then how the heck are they supposed to fix or appeal it? My husband couldn't afford an attorney and ended up being ordered to pay a base amount that is $17,000.00 (not interest) more than what was actually owed. Thank God, it is almost paid now, but we both still regret not selling everything we had to pay for an attorney, it might have been worth it.
I don't mean to discourage you, but I do want you to be prepared for the real possibilty that you'll never get the problem fixed, and that you really need an attorney.
