We live in Arizona.

Recently, my wife was hit by a car while crossing the intersection near our apartment. Neither of us has been able to work until just in the past week due to this. We have been late the last couple of months on our rent, but we always paid it. This month is no different so far.

On the 6th, we recieved our customary 5 day notice. Today is the 17th, and we almost have our rent together. However, it will still be another 8 days or so until we have it all. But, we found a envelope on our door stating "Your electric will be disconnected due to non payment on 9-18-02 if bal. not paid in full!"

I have been looking through the Arizona Landlord/Tenant Laws, and I need to know if this is Legal for them to do. Some sections I found that may apply to us:

33-1364
Sections A,C,D,F
33-1367
33-1368
Sections B and D

Please reply and let us know what to do. We are in a desperate situation :(

Edit starts here: I forgot to state that although the eviction process was completed last month, they accepted our rent anyways which, as far as I know, reinstated our rental agreement since we are still here and they want this months rent. But thus far this month, no action has been filed against us.

Uhm, actually, before you go jumping at sticks like that, I am currently awaiting the arrival of my DD-214 from the VA so I can ship off to re-enlist in the military. It is supposed to be here tomorrow, but I dont know what to do considering this new turn. If you dont have any idea, please say so. But dont go attacking people because you think you know us. That was extremely rude of you, and i hope this isnt where this country is headed considering I'm about to put my life on the line again to protect people like you.

Anyone else have anything of value to say?

Oh, please. My heart bleeds for you. You said, "But dont go attacking people because you think you know us." Of course I "know" you. Just how do you think I had a feeling you were at home and not working? Did you really think I was stupid? I'm not "attacking" you. I'm trying to knock some sense into that "jarhead" of yours. And then, you have the temerity, and the unmitigated gall, with a sick wife, to come here asking for help when you won't even help yourself! Some balls you got there.

What have you been doing to bring in an honest living while you've been waiting for your DD-214? Why are you still sitting on your ass at home? Is this how you intend to treat your wife and family?

Why have YOU been placing your ill wife at risk?

What kind of man are you?

You have NO excuse to be at home, and not earning a living. You could have been out working today to bring in a few bucks, but you chose to malinger at home. What did you think was going to happen - - somehow money would just jump into your pocket?

And then, what are you going to do tomorrow when your DD-214 doesn't arrive? Get a job! Pay your bills! Be a man!

IAAL, please grow up. You try getting hit by a car and see how you fair. We have a 5 year old son and a 8 month old baby. It is kind of hard for a person with a broken leg, shattered hand, 2 broken vertebre, and 28 staples in their head to care for themselves much less 2 very active children. I'm done talking to you. How old are you anyways? You act 13.

When you need money to pay for your bills, you get a neighbor, a friend, a family member, a Nun from the church, you call Social Services, anyone, to help you and your wife while you get off your ass to make a living, you lazy good-for-nothing! That's what a MAN does!

You think. You use your head. You move mountains to take care of your family. You do whatever is legally necessary to bring in an income. You dig a tunnel, you go around, you fly over - - but, you come up with a solution so you can get out there and earn a living.

And, you're an example of manhood who'll be in our United States Armed Forces? Believe me, we don't need men who can't think.

And people wonder why everyone hates lawyers. THIS is why. I dont need anyone other than myself to clean my wifes' body when she cant do it. Like I said, I always get the money, just late. It isnt about whether or not the money is available. Its a matter of the legality of what they intend to do. Do you understand this concept Mr. Lawyer and Professor at a very Prestigious Southern California Law School? And dont reply with "If you were a man, you would have had the money". Life doesnt work that way all the time. I HAVE sat on the corner waiting for some carpenter to work me. I HAVE gone to the temps. I HAVE done what I can. Just use the legal "expertise" you claim to have to help a family out without attacking them. Thank You.

I am not going to help you to be a malingerer, by helping you to not pay your bills. If life is that tough, even though you never say that you tried to get help from family, friends, or otherwise, then tell me, why are you letting your wife suffer with the loss of utilities and rent when you could have filed for Welfare and Foodstamps for your children?

You keep making excuses for yourself, and you hide behind your wife to do it.

You weren't even out today looking for a job. Why do I have to do your thinking? Why haven't you thought of any of these fixes to your problem - - before things got this far?

You know, you think I'm "attacking" you. And, just what do you think your C/O is going to do to you? Coddle you? Make nice-nice with you? You haven't seen anything yet, my friend.

Please, do us all a favor and don't go into the Service. We need thinking men and women.

You also have to plan how to pay your rent and utilitity bills before the lights go out, and your sick wife is thrown out of her home while you're off playing soldier.

manix is there a church program that might assist you paying the elect and part of the rent to get you off the late payment mill ? you know by looking into it the persons you speak with may actauly know of someone who has need for labor . call Lutheran social services , catholic charities , living as far south as you do its likely salvation army energy assistance isnt avail there .

When I first started reading your post, I told myself "well, I've been in his shoes." Last year I had a lot of medical expenses and my rent was late about 6 times in the 12-month lease.

But then I read your post.

Today is Sept. 17, and you are about 8 days or so from having Sept. rent??? Then when are you going to get the $$$ together for October rent?

Your landlord would definitely be within rights to start eviction proceedings on you. Not to mention the utilities cutting you off.

While no one is doubting your family has had its share of bad luck, you, sir, are a squatter.

Your poor wife and young children deserve better. They deserve a roof over their head and frankly, right now, you can't guarantee them that.

I am honestly sorry for your family's misfortunes, but the landlord is running a business. He has his own bills to pay, and counts on you to pay rent on time. A few days late, is understandable. Day 17 of the month and still no Sept. rent, is not.

I already made these, and other, suggestions to him. Do you think he's even tried? He didn't even acknowledge these ideas.
