Hello, I am looking for advice/Help.
My case is as followed I have a 10year old girl that recently received a death threat along with 2 otherclass mates at her elementary school. Another child at there school that has many issues(suicide talk,running away, abuse talk, self mutilation,has hit others) threatened to shoot these three children at school and also had drawing depicting these children crossed out. One of the children involved told and adult at school right away. That adult brang the child that made the threat and the one child that told at that time to the principle. Result-Nothing happened. Parents of the victims were never called,the child was not suspened, the police were not called which according to our save law should have been. When I went to school the next day I wanted to know how my child was being protected I was told I did not have the right to know.I was lied to over and over
from my understanding the priniole broke our code of coduct and save law.The child that threaten these children remained in the same classroom with the victims for 2-3 weeks before finally being removed. There were secondary threats made to these children of which my daughter reported and got introuble for because the priniple never told the classroom teacher about the original threat.My child also rode the bus with this child everyday the priniple did remove the child from the bus on the 2nd day of me going in to school but later returned the child to the bus and did not notify me as I requested.My child has repeatedly been put in a position of danger over and over.There is now lies beening spread around the school by the priniple to others that this didn't happen and is rumor.
I have gone to the superintendent and school board they have addressed issues with the child that made the threat getting her more help but thats it. Nothing is being done about the principle's actions. They asked me to supply them with the proof whick I did even transcripts of the taped conversations. I dont understand how this can happen and be aloud need advise.

I am dealing with school issues too. I think she is asking how to deal with the principal not following school policy. I got that when reading her post.

My questions are what can I do to make the principle accountable for her actions and lack of ?
How do I stop my child or someone elses from being hurt because the principle wont follow policies and the system doesn't seem to care?
Do I have a case for a law suit?

I looked through SAVE Act, and I didn't see anything that indicates that your child's school violated the Act. The general information on Codes of Conduct did not show any violation either. Your school's specific policies may have been violated, but it isn't possible to know that without knowing the policies.

I don't want to dismiss your concerns, but it seems that all of your information is hearsay. The school has undoubtedly investigated the incidents and determined that there is no imminent threat. I suspect there are many other issues at play that have influenced the manner in which the school responded. As a parent, I understand your concerns. As a teacher, I understand the school's position.

I don't believe you have grounds for a lawsuit, but you can take your concerns to the New York state board of education or department of education.

Did you report this to the police?

Apparently a disturbed child ... with luck they have referred the child to therapy.

And what prevented YOU from reporting it to the police?

Depending on the nature of these threats and the age of the suspect child, there may not be anything the state can do about it, but it would be worth a try to get it before the police.

Threats against the child may be in violation of some school policies, but that is something to take up with them.

Well, is there any proof of the threat besides the statements of the girls? Granted, that's something, but it may not be conclusive and the school may well have found that the threats are not verifiable.

What would you prefer? Thumb screws?

If you are unhappy with the actions of the principal and the superintendent, take it up with the school board. If you feel your child has been the victim of a crime, report it to the police. If you feel your child is not safe, then withdraw them from this school immediately. If your state allows for restraining orders to be issued in such matters, perhaps you can seek one.

You have options. Very often schools do NOT have the same options. For instance, if the student has an IEP in place that addresses and in some way justifies this behavior, the school may have its hands tied in how it deals with the issue.

I read it a little different. As a parent, I would have pulled my child out of that school untill it was dealt with the right way.
I still don't see anything that suggests the school violated the SAVE Act. From my understanding of the post, the school investigated the threat. For all we know, the school found that the student who reported the threat had lied.

As a parent, I too understand her concern. However, I believe there is much more to this story than what was written.

File a report with local law enforcement

From personal experience (I work in an elementary school), it is not uncommon for school administrators to try to handle these types of incidents off the record.

If I were in your position, I would call local law enforcement and file a report. At the very least, you have registered your complaint and it may help if there are issues further down the road. We had an identical situation at our school and the principal suspended the student in question for 3 days. It's a serious event, and if your school district has a zero-toerance policy regarding violence then the principal did not follow proper procedure.

I would call TOMORROW so that they can collect evidece before school is dismissed for the summer.

Hello I want to thank all the have this far replied to my post. getting different oppinions and thoughts have helped alot. I couldn't type my whole situtation on the post as it is 42 pages long. but I have gotten statements from everyone that was involved and have evidence hard evidence that cant be disputed.that the school lied to and withheld information from parents. That they could have given us with out violating anyones rights.And that what I have and the other families have been put through for the past few months has been do to the principle. I did call the police and it ended up that I learned that there was even more inappropreated things done by the school.then I originally knew about and that the principle has also proven a personall bias against my family because I have complained . She tried to verbally go after my daughter.There is now a meeting taken place in a few days to hopefully end this nightmare.
