I think you are thinking of the old Arribasoft case, http://www.eff.org/IP/Linking/Kelly_v_Arriba_Soft/20030707_9th_revised_ruling.pdf. Note, however, that Google just recently lost a case dealing with their display of thumbnails, http://www.foxnews.com/story/0,2933,185635,00.html.
