What is the name of your state? Florida
When probation is running concurrent in 2 counties and one county arrests for technical violation- what is the time limit in which the other county has in which to file an Affidavit of Violation?
The probation in both counties is for the original offense.
Probation violated in 2001- court ordered that probation continue in both counties to run concurrent.
Probation violated in 2004 (failure to report new address, reported 1 day late).
Arrest made March 31 2004 on the violation by the county of residence. Arresting county immediately notifified other county of the violation and arrest.
Probationer remained in county jail from date of arrest until March 5 2005. At which time was transferred to state prison after accepting sentencing agreement of time served plus 13 months in prison. Probationer told that the agreement was to run concurent in both counties and that when released from prison probation would be done. ( learned 2 months ago that none of that was put into the actual court order).
In Sept. 2005 (16 months after arrest and notification) the other county filed an Affidavit of Violation- for the same violation. Instead of being released from prison he was transferred directly to county jail and is awaiting a hearing.
I've tried to find something on the probation guidelines for Florida with no luck. I'm hoping that someone here may know the answer to my question. Thanks in advance.
