We live in NJ and my husband works for a small architectural firm of about 30 employees. He is a salaried employee with the compnay for over 2 years now and has given them his all but he just been diagnosed with bi-polar and part of his treatment is that he sees a counselor every Friday at 3:30 this cuts into his work week and he has tried on numerous occassions to get a better hour but can't the counsleor has even given his job a letter stating that this is the best time for him. His job is now asking him to make up that time. I thought salaried employess didn't have to do that. They have no problem accepting his overtime (unpaid) but are threatening to dock him pay if he does not make the full 40. They are making him cut into his vacation and personal time because of this which we are going to need once our son is born, he will need open heart surgery and my husband will have to take 3 weeks off because of it.
