What is the name of your state? MO

Majomom1 is at the courthouse right now for the hearing on the family access motion she filed. (See her threads)

Hearing is to begin at 1030. She just texted me to tell me that her ex, his wife/girlfriend (claiming common law marriage and therefore more stable than single mom) and majomom's SON (who is being withheld by father) have just arrived at the courthouse.

Other than the fact that Dad is OBVIOUSLY in contempt of the order - he's been withholding the child out of state since mid-August and has even enrolled him in school in KS...

Isn't it REALLY bad form to show up at court w/the child in tow (child is 16) for a hearing about returning the child?

Well, no - if I understand you correctly. He might be bringing son back JUST IN CASE he loses.
That's what I'm hoping for. But he's also already told Mom that since this weekend is his, she can expect the child to refuse to return on Sunday night.

Tks. I promised I'd keep the txts coming until 1030.

He's filed a motion for an in camera interview for both kids - the one he's withholding and the on he'll 'take if he has to'. Hasn't been heard yet though.

She's freaking out and her attorney hasn't arrived yet...

She's planning to ask that his visitation be suspended until the Modification hearing on Nov 16... to rebuild her relationship with her son, and also as partial make-up time for the past 2.5 months.

I would say he has no weekend time coming and the judge if ordering a return will order an IMMEDIATE return. Make sure Majomom brings up what dad said about not sending the child if he gets child this weekend

Tell her to breath and be rational and calm and explain in facts. She should ask that visitation be suspended until the hearing. It is a reasonable request. I have to run to trial but a child SHOULD NEVER be brought to court. Not in a DR case.

She will. I've been drilling her like mad through this whole thing. She's staying right on top of her atty too... so I guess we just all cross our fingers now? I'm personally invested because this is MO and I don't need to find out that they won't enforce their own orders...

Her requests seem perfectly reasonable.. tell her to speak up for her son.. her x is unbelievable.. i hope he gets the slamming of his life! and to nudge her attny to say what needs to be said..

We're in central time. It's 1045 here.

She's in and out of the courtroom right now... there are 2 cases before them, but she should be in front of the judge any minute.

She has very clear orders to call me the second she's out of there, but if she actually GETS her kid back, it might be awhile.

I'll let y'all know as soon as I know anything.
