I read through some of the posts here looking for answers to my current problem. I recieved a collection for an old att wireless account from cavalry portfolio. I sent them a validation letter asking to show me proof of contract and charges. They sent me a response letter last week with a invoice of the bill. No documents showing I signed for this service and nothing showing billing and payment. It also took them 3 months to respond.
First question is about 1692g of the FDCPA which states - Failure to send the consumer a 30-day validation notice within five days of the initial communication
Does this mean they only have 30 + 5 days to respond to my validation request? If so then can I tell them to drop the collection for failure to respond in time?
Second question is about the validation. Is there any legal way to make them show proof of the billing like I asked them the first time? I would really like to see copies of statements before I agree to pay them. This debt is 3 years old coming up on 4 and I can't remember if I paid it off or not.
