UGH!!! I have been divorced for approx 8 years. On an average, I have been to court, once a month for the past 7 years. This is not on my part but my ex will file a motion for whatever is bugging him at that time. No,this is no joke. He fought me for custody for 3 years and lost joint custody. He now has visitation every other weekend. An issue has been with the kids, who are 10 and 12 and their activities. He refuses to participate i.e take them, come watch them etc. It was ordered by the court that he is not to interfer with their activities and I provide 100% transportation, not a problem. I now have an issue, which he filed a motion, that he wants more parenting time. He works nights and is rarely there when the kids are there. He is remarried (4th time) and our children stay home with her children. Neither adult is present. A family outting to him is taking my children to a bar. My kids have voiced that they do not want to go.
My first question: is there a way to make him stop filing petty motions? I can't continue to take time from work. I know this is a silly question but I was hoping there might be something.
second question: from what I am finding, there is no legal age where the kids can voice if they want to go or not. Why are his rights more important than that of a child? I can understand if they are very young and throwing tantrums but these are older children.
third question: is there anything I can do about him taking my kids to a bar? I don't have proof other than what my kids tell me.
