What is the name of your state (only U.S. law)? Ohio
I recently got divorced and the divorce decree orders my ex husband to have his name removed from the title to the manufactured home that I live in. The divorce decree also reinstated my maiden name.
When attempting to comply with the divorce decree, my ex husband was told that the only person who can remove his name from the title and change my name on the title to my maiden name is the holder of the lien (the manufactured home was bought with a personal loan, not a mortgage, from an investment company--there are about 2 years worth of payments left). When my ex husband went to this investment firm to comply with the court order, the investment firm told him that they refuse to remove his name and refuse to change my name. They told him they would only consider doing this if the loan was refinanced or the loan was paid in full.
Can this company defy the court order? Do I have any recourse to get my ex husband's name off the title? I'm tapped out financially because I had to pay for the divorce alone out-of pocket and had to deal with a legal issue involving my son, so I can't afford to just hire an attorney to fight this investment company.
