TN parking lot accident (didn't call cops)

What is the name of your state? Tennessee

My friend was hit by a backing car in her Apartment's parking lot. Her car has some minor damage, so she tried to call her insurance.

However, a girl who drove another car said she was afraid of her insurance rate that might be increased and didn't want to let her insurance involve. She said that she would pay to fix the damage. Since she was in a hurry and live in the same apartment complex, we (I went to the scene later) decide not to call a police/insurance and let her go. :eek:

Today we call her and she said it was not totally her fault, and she wants us to share cost of fixing the damage.

Does anyone know if we will be able to get the full cost of fixing the damage from her? :confused:

We got all information from her (e.g., driver license number, insurance, license plate). However, we didn't call the cops and insurance.

Call her insurance company and file a claim. They will investigate and make a determination of fault.

Both cars were moving. The person B was backing up her car from the parking lot. My friend (person A) was driving. The person B's car's rear hit the front of my friend's car.

Okay. If your friend was driving straight down an aisle, and the other person was backing out of her space, then the person backing out is usually determined to be at fault. In this case, then, yes, your friend will be able to recover $ to have her vehicle repaired, up to the limits of the policy.

In any accident, its usually wise to call the insurance company.

But after I read the Michigan Parking lot accident thread that mentions that parking lot accident is considered no fault under Michigan state law, I am afraid that the TN law will be the same too. Do you know if this is not the case in TN?

From what I can determine, TN is NOT a no-fault state like MI. Therefore, the claims are handled differently. So, in TN, the at-fault party is responsible for all of the damages.
