Hi, I was in a car accident last yr. Recently I received an interrogatory. I'm not sure how to answer 1 question in particular. It reads, "Do you allege that the accident set forth in the Complaint aggravated a pre-existing condition?" I was in a car accident before & suffered back & neck injuries, just like I have in this accident. Honestly, I don't want to say this recent accident did aggravate a pre-existing condition if it's going to affect my outcome negatively. I also, don't want to say it didn't aggravate a pre-existing condition, because the defendant's lawyer may not believe me. Is there any good/right or bad/wrong answer? Thanks

how long ago was the first accident? when you stopped treating for the first accident were all of your symptoms resolved?
 
It was in 2000. Yes my symptoms were resolved. But I guess my ? is, is there a particular way to answer this question without looking lilke I'm faking? Thanks

If your symptoms were resolved in 2000 and you have had no treatment relating to those symptoms since, then my opinion would be that you have a new injury...
