In what manner did her attorney say the papers were "not legal" ? How, and in what manner, and upon whom, were the papers served ?

Her lawyer said something about the papers not being in the right format and that some things were missing and others didn't need to be there. I served the papers to her myself.

My response:

Okay, there's the problem.

You blew it when you served the papers on her yourself. You're not allowed to do that because you're a party to the action. You need to have a Process Server, or someone over the age of 18, not related to you, and having no interest whatsoever in the action, serve the papers on her for you. And then you need to file the Proof of Service with the court clerk.

I hope you filed your Pleadings with the court clerk first, before you served them, and received a Case Number.

Listen. This was only your first error, and a simple error at that. But, it's very telling of the problems you're going to cause yourself in the future - - because now it's obvious you have no idea concerning the laws of your States' Civil Procedure laws.

Please, while I absolutely applaud your efforts in this matter, and the stellar job you've done in compiling the Pleadings, you really need a local attorney to take you through this matter. At the very least, if you can't afford an attorney, get a "How To" book on the subject of Dissolution of Marriage, and follow the instructions, step-by-step. If you had had such a book, and followed the instructions, you would never had made the error of serving the Pleadings on her yourself.
