You guys are really close, and I am sorry I didn't fully complete my thoughts from before. Our Warehouse guy is flying up to Georgia thursday to pick up the auto (of this terminated employee) and drive it back. Myself and the EVP thought that that costs can be deducted from his final expense report not his salary. As stated earlier his contract states "Upon termination of the employee's employment for any reason, the employee shall immediately return said automobile to the company". Can we deduct this cost from his expenses??? Once we had this happen before the individual drove the vehicle back from Coral gables, Fl to our tampa, Fl office and we paid him for his fuel and lodging.
This other fellow just has left the car in his apartment complex area and his sending us the keys express mail and wants no communication from us according to his resignation letter.

This guy was on Disability for three months came back just a month ago and now resigns.

I was close but no cigar.

I can't see any reason why the cost of having the car returned to HQ can't be withheld from his expenses. From his wages, no. From his expense check, yes. For what it's worth, I think you're justfied in doing so as dropping the keys in the mail hardly meets the criteria set forth in the contract. Basically, he walked out and left you holding the bag. Or the car keys, as the case may be. :)

I agree - as long as you deduct it from his expenses and not his wages I see no problem with it.
