What is the name of your state? The attorney I talked to is going forward with my case. I guess the attorney general's office decided to re-open my case. This is good. Plus we found out the company did put this guy on probation, but after firing me, he is no longer being watched and back to doing the same thing. Sending porno pics and stuff to others at work from his website. We also found they did not let me go the same as all other employees are terminated. That is by meeting with manager, and a termination letter. I was fired by phone. Even though this is not illegal it is not policy of company on termination procedures. What the company did was put my complaint under the rug, and got rid of me to undermine the issues at work. Faith

It's very confusing when you do this.

Post in one of the thirty other threads you have started so people will know what you are talking about.

:( Be fair now, only slightly more than half of her 30 other threads were on this same subject.

You have an attorney. Either you are paying him/her for legal services or, if your case is on a contingency basis, you will pay if you win. The attorney is privy to all the available facts. You need to let him/her do the legal work for which you are paying. Most professionals don't like clients who try to tell them how to do their job or report to them what they've learned from internet sources.

You can't let this work episode and any legal proceedings attached to it consume your life. It seriously appears that you are headed in that direction. You've written so much; I can't remember the nature of the alleged sexual harassment. But, unless it was quid pro quo or particularly egregious hostile working conditions, it's unlikely that, even if it's determined that you suffered illegal harassment, you have substantial damages which would result in a large settlement or award.

So, the company didn't terminate you in the same fashion it used to terminate others. You got a telephone call and the others had a meeting. Could that have been because you were absent on the day you were fired? If the company didn't handle your termination correctly, the relief is not to void the termination. It would be to call you in and tell you face-to-face that you were fired. The result, however, is the same. You are unemployed.

It's not a violation of the anti-discrimination laws to put your complaint under the rug, in the sense that it was not openly discussed. The information you provide indicates that your employer investigated your allegation and may have taken some disciplinary action against the alleged harasser. Further, it moved you to another area at your request. You now contend that the harassment and move were so stressful that you became ill, which required frequent absences from work. You think that your employer should excuse your absences. I don't know of any requirement that they do so.

You need to turn this one over to your lawyer, stop researching the issue and related matters on the internet, and move on with your life. Your obsession with this is probably what's causing a good deal of the stress you feel.

I did ask to be moved and they did move me. BUT, the move they made I lost all my certifications on the tools I worked on which was just wrong, since they could of moved me where I could still work on the tools I was certified and trained for. Secondly, because of having to be re-trained completely in this new area on these different tools it forced me back into the old area I was harassed in where these new tools existed as well. So the move did no good. Thirdly, what you are describing as put under the rug you interpreted incorrectly. What I meant when stating they put it under the rug was after they let me go. The complaint was into HR. My meaning was that they completely ignored the situation. If they had followed through as required, I would not have asked to be moved. It should of been the harasser moved. They did not move me until the harasser found out about the complaint and created an unbearable hostile environment. And lastly, my attorney wants me to research. As a matter of fact, my attorney has been very happy with some of the research I have put together. You seem to think that once an attorney has the case, you do nothing more. That is not even close to the truth. I know many clients who are very involved in their own cases. I have appreciated all the responses I received here, and have much respect for many of the people who responded with great advise. I am in counseling, and am now looking again for full time work. This does not engulf my entire life, at least not anymore..lol. Thanks again, Faith
