When incidents have occurred between my husband and his ex where she has violated terms of their JOD and parenting schedule, is documenting everything (by email correspondence, detailed journal, etc.) sufficient or is he supposed to be filing motions each time something happens?

The concern is that, in the future, if they go back to court for a modification of any kind his concerns over these violations won't be taken seriously if he hasn't had them addressed by the court. On the other hand, he doesn't want to look petty by bringing every violation to their attention (there have been at least 2-3 every month for over a year, but not always "big" things).

(Because someone might ask, when I refer to these "incidents", I'm talking about things like violating ROFR, not adhering to the parenting schedule by not showing up to get the kids, making school decisions/setting up meetings without involving hubby (who has joint legal), etc.)

Thank you guys for your help!

I would say for your husband to continue documenting everything---It's up to him as to when he wants to go back to court.

There's no stopping him there...he's a biggie on keeping hard copies and notes on everything. And, there's no saying that another stint in court will ever happen between them (let's hope not, anyway-he definitely doesn't want to to go through that again, I can't imagine anyone would:rolleyes:). Thanks!
