I am from New Jersey, and just a few day's ago my ex-wife lost her petition to relocate my children to the state of Nebraska, where she found a man on the internet. Now, she has said to me that she is taking the children for a week to Nebraska around Christmas time, and that I have no say in the matter. I am afraid that if she goes, that she may not return with my children, for outside her home currently is a truck loaded with household goods that belongs to her brother and his wife, who are soon to move in the house she is currently renting. This information was obtained by my 18 year old son, and I did see that truck. My question is obvious, presenting all that I have above, she is obvious a high flight risk, and I want to know what I can do to prevent this trip to Nebraska with my kid's. If I have to file charges with the prosecutors office I will. Thank you for all your help.

Until she actually tries something I dont see there is much you can do. You stated that there was already an ordering stating she couldnt move children out state correct? So if she does then you immediatly rush down to the court house file contempt and for emergecy hearing. She will be ordered to return the children immediatly since she would be breaking the order. If she tries this Im pretty sure mommy could say goodbye to kiddies and you would be granted custody.

There is absolutely nothing that you can do to stop mom from vacationing out of state with the children.

If she doesn't come back with them, then you get an emergency custody and pickup order and go get them. Nebraska isn't Outer Mongolia you know...

Do you have Joint Legal Custody ?

When the petition to relocate was denied , is there any language in the decision that she shall not take the children out of State ?

Correct me if I am wrong

Correct me if I am wrong, but, in the State Of New Jersey, just the threat of taking a child out of state makes a judge think.

I do not even think you have to prove it. The threat alone blindsides judges.

Just stating that they threatened to take the child will open the judge's ears.

Mom can take the children out of state to visit. And you are wrong -- evidence would be necessary.
