We live in New Mexico. My family moved out of a townhouse 2 months ago. We lived there for 16 months prior to moving. The lease had expired prior to moving out. We had no contract or lease. I spoke with the landlord that we were looking around for a place that was a little cheaper. I told her we would probably not be able to give her a written 30 notice, but as soon as we found another place, I put in writing during the middle of the month to let her know we would be moving out in 2 weeks, which would be the end of the month.
Our dispute is, she told us because we did not give her a 30 day written notice, she would be charging us rent until the townhome was rented out again, unless it could be rented out by the 1st of the month. After we moved out, she used the $800.00 deposit for damages and cleanup. From that amount, she charged us $450.00 for rent into the next month. She never rented the townhome, but put it up for sale. We have no problem with paying for the damages and cleanup of the home, but do not agree with her about the extra rent she tacked on and feel that we were taken advantage of. Who is right and who is wrong?
