Last summer I had a man tell me that he would help me get a good deal at a local health club that he worked at. I agree and i met him along with one of my friends at the gym that he worked at. I told him that i needed a membership for three months and what was the best deal that I could get on the membership. He informed me that I needed to sign a contract for two years and cancel it after the three months by letting the manager know that I would be unable to keep on attending because I would be moving. I agreed and as I signed the contract I asked him what all this writing meant. He told me not to worry about it, it was just what he had explained to me. After three months i went to cancel and the lady gave me a little hassle. she said that I must move fifty miles away. So I went to a website and got a form that stated I was going to move back home from college, the form stated that my house was 50.4 miles from the building. She them told me their was another gym in the 50 mile range that I could attend. But this gym was almost as far as the gym that I would be moving from. Also i was never told of the going to another gym thing in the contract. So I finally got the man who sold me the membership to talk to her and she agreed that she would release me any way. A few months later i received a letter from a collection agency that stated I had not been paying. So I went back to the place and talked with the head manager he informed me that he would also take care of the contract and I had nothing to worry about. He called this agency and that particular one never contacted me again. A few days ago i got a letter form a collection agency that stated I had 30 days to pay a bill that I was unaware was due, because of what I had been told by the managers. I thought that I was free, but they somehow are trying to get me again. What should I do. I tried to make this not to wordy.

What rights did the written contract give the gym in this situation, and what rights did it give you? If you can find anything in the contact that will help you, that is best.
If the contract gives you no right to terminate, then you have to rely on the oral agreement they made to release you. The oral agreement is valid, but he problem is to prove it.

Another possibility you have is to show that your were fraudulently induced to enter into the contract, because of what you were told. If that is the case, you had a right to terminate the contract at any time.
