totaled or not?

What is the name of your state?Oklahoma but the accident was in Texas.
My son was hit it wasn't his fault, he has gotten a rental car that the other driver's insurance is paying for, but we still haven't heard from the insurance as to what they are going to do about his car. If they total it, can we require them to give us what it would cost to repair the car back to the shape it was in before it was hit? The car will still start, so the engine is still working. If the engine still runs, do you think it is fixable? If they total it and they only give us NADA low retail for it. Can we keep the car for parts?

If the cost to fix the car is greater than the value of the car then you will only get fair market value. Then the car becomes the property of the insurance company.

Who knows? Possibly... Maybe....

This is something you need to work out with the insurance company. Sometimes the insurance company will total a vehicle and then let the owners keep it for $100 or whatever.....
