I am helping our small town with their code enforcement. One of the issues is a large commercial trash receptacle being permanently stored in the Town right of way. The parties involved refuse to move it, and we can not find any Town ordinances or State Statutes regarding trash receptacles specifically.

Oh, by right of way, we mean the area between the road and their actual property line. It is unpaved, and normally used for parking. They have also landscaped onto Town property using deeply tiered rock work, and large bushes. The dumpster is just blocking the bushes, and then the rock work. If there were a fire on the property they have effectively blocked all access to their property by fire trucks.

We did find a fire ordinance that says No person or persons shall allow to remain longer than thirty-six (36) hours, or overnight, in any alley, or on any sidewalk or premises within thirty (30) feet of any building , empty boxes, barrels, rubbish, trash, waste paper, excelsior or other like combustible materials.

But we are not sure that applies to a commercial dumpster on Town right-of way, any help???
