Townhouse complex problems....

What is the name of your state (only U.S. law)? New York

I live in a townhouse complex and the magagement company is trying to make everyone have 2 assigned parking spots. If anyone has more than 2 cars they have to pay $50. When asked why they said because the parking passes are very expensive and they have to paint the spots. Shouldn't everyone have to pay for their own passes? I feel like only the people with 3 or more cars are paying for everyone else.

Other issues are that there wont be enough spots for everyone. In my parking lot we would have 38 assigned spots out of 40. We have at least 2 units with 3 cars, there is the 40 spots. If there are other units with more cars where do they park? They are pretty much making it so that people that live there cant even park at there home. Other areas have much less parking so this problem will be much greater to them. Then there is the problem with having guests over...where do they park?

Maybe this just seems wrong but I really feel like something illegal is going on here. Please let me know if there is any other information you would like to know. I am curious if we might have a case against the management company here.

I don't see anything wrong. If the management wanted to, they could limit each unit to ONE parking place. :cool:

Doesn't sound illegal to me, actually what the complex's management company is doing is very common, reasonable and logical. They're trying to ensure that residents are not inconvenience by other residents who have additional vehicles or excessive guests. You imply what management is doing is unfair to people who have multiple vehicles....well do you think it's fair that a resident who has 1 vehicle has to park on one side of the complex to walk to his/her townhouse on the other side of the complex because his/her neighbors have 3 cars or decide to have a gathering at their home and have their guests park in spaces directly in front of the building?

As far as the availability of spaces. Logic says that each unit would be assigned 2 spaces in front their building. The additional spaces would likely be determined on the availability of spaces near the building on a first come basis.

Whats i meant was unfair about people with multiple cars was the fact that we are the only ones that have to pay. Everyone should have to pay for there own passes and spaces. And I think if I am paying anything I should definatly have a spot!

So its fair that some people that live there wont have a place to park? We have at least 5 units in my area that only have 1 car. There are 5 spots going unused. Now my neighbor already said I could use his spot but thats besides the point and what about everyone else? What about when one of his kids comes to visit? They have to have enough places for everyone that lives there to park. Now I can really only talk about my area but we RARELY ever have a problem with not enough spaces. If other people do then they should work it out rather than make hundreds deal with other peoples problems.

Only giving each unit one assigned spot would make things a lot better actually but even that is unnessary. Someone said that there are a couple people with 5 cars parked in "better" spots and they dont use there cars that much so thats why they are doing this. So instead of dealing with a couple people they are inconviencing hundreds? They could come up with parking rules instead of making it difficult to park at your own house.

Sorry, but I respectfully disagree with your opinion and I'm sure the majority of your neighbors would too. As unfair as it may seem to you, when you live within any kind of community that has rules, regulations, etc then there is always going to be someone affected more by the rules or decisions that benefit the community as a whole. If you don't like the rule, you have the option of moving at some point.

But back to the original purpose for creating this thread. No, I don't believe you have any legal recourse to change management's decision.

Thank you for your opinion. Do you live there? The majority of the development probably wouldn't agree. There are a lot of people living there and it wouldn't just be affecting "someone" its going to affect a lot of people.

So the majority of the residents have more than 2 vehicles? Because that's who will be affected by this decision. As far as visitors, depending on how often a resident has visitors, then it won't be that big of a deal. And neighbors can easily get permission from their neigbhors who may have extra spaces for their visitor(s). Evidently, for this policy to take place there were residents having issues about the availability of parking spaces.
