i worked 14 years for a japanese company in california. i started as a sales rep and was promoted many times over the years finally becoming national sales manager. the president (american) has a terrible reputation for bullying, verbally abusing and demeaning all the employees. he also has a terrible reputation with many companies who for this reason will not do business with the company. as director of the division my sales were up 22% for the 1st quarter 2001. my sales rep was expecting a $250,000 new order & was told it would arrive within the week. by the end of the week this account said they would still go with the product but needed a few more signatures and may take another week or so. when i told the president in front of the entire office he accused and screamed at me that my people and i do not know what we are doing and not communicating. he then brought me in his office and threatened to write me up, which goes in the HR files. i have never received one in the 14 years their and if you receive two you can be dismissed. he then said i had a short period of time to get things corrected or i would be either be gone or demoted. that was friday, the following monday after he was screaming at an insurance company for personal reasons he called me in, wrote me up and told me to sign it. i refused to sign the document & gave him my 2 week notice. now my counterpart, who is japanese, sales are way down, but the president will not dare do the same. it is well known in the company he treats the japanese employees differently. it is also known and documented that all the japanese employees make more money than the american counterparts. this is also true in my case not only for my counterpart but for japanese managers who reported to me. i complained about this at the end of last year both to the president and VP, who is japanese. nothing was done & the VP had said it is a different situation & they come from japan. this is why they get higher pay, paid housing and other perks. i was told years ago by the president no americans would make more than the japanese (that of course did not apply to him). i documented to HR i was leaving due to the president, but did not say anything about the discrimnimation in pay. however, both the president and VP are aware of my complaints and how i felt being disrciminated against. my question is do i have grounds to sue due to a very well documented toxic environment and discrimination in pay? thank you for your advise.
