Toyota Keeps Breaking Cease & Desist

I have a loan with Toyota Financial. I have a Cease and Desist on file (twice) send by certified mail. This cease adn desist is on all numbers, except for one number where I am willing to talk to them. Customer service has confirmed the cease and desist on file numerous times.

Yesterday Toyota called one of the numbers on the cease and desist. I asked the rep to confirm that cease and desist, he put me on hold and came back, apologized and said he'd have to call me back on another line.

Do I have any recourse for this continued breaking of the cease and desist? I read that one lady successfully one a lawsuit against a company for just this.

Now, my situation is that Toyota says I owe them 2 payments, plus late fees and my records indicate that I owe then 1 payment (current) and no late fees. Several Months ago I did a deferral and fees were waived. As of last night Toyota said they used X funds paid to pay on Z and that caused Y to move to K... etc. Basically they've done their own internal fund transfer and didn't count the deferral as agreed.

Thoughts - other than, "pay your bills, get a job, you're a loser, sucks, etc."

Toyota Financial did you a favor/courtesy by allowing you to defer one month's payment. I'd be very surprised if there was something in the finance agreement that required them to let you skip a month's payment. So you need to pay your loan in accordance with the terms, or be prepared to be hounded until you do. Unless you have something in writing that says they allowed you to skip a month you don't have a leg to stand on. Furthermore, you're under the mistaken impression that this "cease and desist" letter compels them to stop contacting you about the late payment.

Since when is a cease and desist not valid? I'm confussed. Even the Toyota rep said he could no longer talk to me on that line after he realized he called a number with a cease and desist on it. Can you please clarify your statement?
