I recently had my items removes from E-bay because they said I was infringing on someones trademark. I emailed the woman to find out what her trademark was so that I could relist my product without any more trouble. She refused to give me any information. I am under the understanding that the trakemark is on the name of the product, not the product itself. Am I right? Also the copyright would be on the description she has written in the ad, not on the product. Wouldn't she have to have a patent on the product to keep me from making and selling it? (I probably should mention that this is a handcrafted product) Thanks for any help.
