What I am trying to find out is I bought a trademark and business in California. If I closed the business ('95), is the trademark still owned by me and for how long? Is the trademark territorial (if bought in one part of the state can someone else use it in another part of the state?) Since I bought the trademark and the one I have currently found has a date later than mine ('98) is he still entitled to use it? This trademark is unique and I have much other material related to this mark. I do not believe the use of this trademark is coincidental and I did buy the rights to it. Just because I am not using it at this time does it mean I lose the rights to it? Am I able to be compensated in some way for someone else using this trademark?
