Shortly after filing Chapter 13 Bankruptcy, I received a traffic citation and was fined. Unfortunately, my BK plan takes any extra money I would need to pay that fine. A few months later, I received a default judgment and the fines doubled. I requested a hearing for a financial review. I informed the judge that I was in Chapter 13 and requested the default be removed and to allow me to make payment arrangements for the original fine. She did not remove the default and ordered me to pay $500 of the now $1000 fine then I could make payments on the remainder. Needless to say, I could not do this. What happens now, do they add additional default fines?
Is there anything I can do at this point to reduce those fines? I thought under bankruptcy, everything stopped (debt collection or civil actions, etc.). I want to pay the original fine and get my license back (suspended for non-payment). It would seem to me there is some protection against these defaults when the court knows I am under a very strict payment plan with the BK court.
Any thoughts?
