What is the name of your state (only U.S. law)? Pennsylvania

So this is how my story goes. My friend and I are both underage, and we had been drinking; I knew I had to drive so I purposely drank very little. When I was taking my friend back to her house, I unthinkingly went through a light as it was turning red. I got pulled over, and my friend and I both got breathalyzed because I had been "all over the road" according to the officer. I blew a .018, the legal limit for an underage driver who is driving under the influence is .02. I couldn't be charged with a DUI, but I did get a traffic violation for running the red light.

My question is, if I fight the traffic ticket in court, and the officer shows up then can he bring up the fact that I had been drinking despite the fact that I was under the legal limit? Is it possible for me to get in more trouble than I am in already? I really would like to avoid points on my license; I am a poor college student, and if my insurance goes up then I won't be able to afford it. However, I would take the points on my license to an underage drinking citation any day.

Any help on this matter is greatly appreciated.

You were drinking. That can be brought up. You could still be charged. You are allowed NO ALCOHOL under the age of 21. The police officer CAN bring it up. You being poor matters not. You still were rich enough to afford to drink.

You were given a free pass. Take it and run (after paying your fine).

If you fight it, you may get impaired driving, MIP, and maybe others... then you will be a poor student that walks everywhere.
