Hi,

My husband and I bought a house many years ago (I call it house no. 1) and it’s under both of our names. Couple years ago, my brother was trying to get a loan to buy a house for himself (I call it house no. 2 ) and since he had no credit, I applied for a loan under my name and bought the house for him thinking he will be able to pay the mortgage himself.

Unfortunately he wasn’t able to pay the mortgage for months now and as a result of that, I received a letter in the mail the other day saying if I don’t pay the balance, they will take me to the court and will be getting a judgment against me which will make me liable for the amount he owns.

Now, I understand if they get a judgment against me which they will very soon, they will be coming after my own house (house no. 1). So, my question is, if I pay off the house no. 1 and then sell it to my husband (so it will not be under my name anymore) before they take the judgment, will the authorities still be able to trace it down and put a lien on it or not? Please help me if possible.
