Transfer case to my state

What is the name of your state? Michigan

In a previous thread I obtained help with questions about custody transfer.

Now I think I need to get my son's case moved to the State of Michigan from Pennsylvania. Will I need to get a lawyer or is this something I can do simply by filing my custody papers in the State of Michigan at our county courthouse?

Thanks for an help anyone may be able to provide.

His mother does still live in PA.

Talked with her already and she's very upset (I sort of understand). Swears she's calling her lawyer. I believe this time she'll have to pay herself instead of having one provided for free by the State of Penn.

Then you cannot transfer the case.

Chances are, if one party still lives in the originating state, that state will not allow a change in jurisdiction. That is called 'forum shopping' and is frowned upon quite strongly.

Why do you think jurisdiction should change?

I would think the case and jurisdiction should change since he lives in Michigan with me now and I am the custodial parent. NOT a problem if it doesn't change. I have consulted with and hired some darn fine lawyers in PA.

Like my dear friend Silver said... not how it works.

PA will retain jurisdiction and any future court actions will take place in that state w/you travelling for appearances.

That is forum shopping. Doesn't matter what you want. Matters what the law says. The jurisdiction began in PA and while one party lives there that is where jurisdiction remains.

And as my dear friend CJane said, move to PA. :)

No one here is "accusing" you of anything. This is merely how the law works; in this instance, it exists in part to prevent "forum shopping."
