I am renting an apartment. My friend was moving from NYC to live with me. I wanted to transfer within my building to a two bedroom. I paid the transfer fee to hold the apartment. It was paid to the leasing agent. The resident manager rented the apartment to someone else. I know from these pages I have no recourse.
I was not refunded that transfer fee.
A blank leasing agreement I had signed before leaving town for a job (I was told to sign it and if the two bedroom could be sorted out they would fill it in for me) was later filled in for a penthouse one bedroom apartment that I had looked at but had no desire of moving into. My friend ended up having to get her own apartment elsewhere and I stayed in my studio apartment.
Now the Property Management company refuses to refund my 500 dollar transfer fee saying that it is a deposit for the one bedroom penthouse apartment that I did not move into (included in the transfer fee is cleaning costs for the new apartment). The transfer fee was paid 7/22/05.
I requested receipts of all moneys paid as nevada law nrs118a.250 allows. There is nothing that says that a "transfer fee" is non-refundable in any paperwork that I have signed and nrs118a.200 says that they have to include in a lease any fees that are required, the purpose for which they are required and the condition for their refund. No transfer happened. No transfer fee was returned.

How can I get my money back?
I do not want to pay a lawyer for more than I would get back (defeats the purpose) is there a way of getting my money back utilizing a lawyers services and having property management pay my legal costs?
Is it legal for them to add things to a leasing agreement (even a mostly blank one) weeks after I have signed it?
